OnlyFans Faces Class Action Over Automatic Subscription Renewals
A new class action lawsuit has been filed against OnlyFans.com (Fenix Internet LLC), accusing the platform of violating California’s Automatic Renewal Law (ARL) by automatically enrolling users into recurring subscriptions without clear disclosures.
Plaintiff Jeremy Gates says he signed up for a $4 subscription in April 2024 but was later charged $20 per month without his knowledge or consent. He alleges that OnlyFans failed to provide the required “clear and conspicuous” terms and posted charges to his credit card without proper authorization.
The complaint, filed in Delaware federal court, claims this conduct violates California’s False Advertising Law and Unfair Competition Law. Gates is seeking to represent all California users automatically enrolled in OnlyFans subscriptions on or after May 13, 2021.
This is not the first time the platform has faced legal scrutiny over its renewal practices. A similar lawsuit was filed last year, raising identical concerns.
